Please read the THAS Pet Agreement "Buyers Contract" below. Each buyer will be presented with this contract in which they will be responsible for signing prior to receiving their puppy.
Tennessee Hills Australian Shepherds Buyers Contract
This is a binding contract between the seller, Nicole/TN Hills, and the buyer, ________________________. Said puppy/dog is sold to buyer on __________________, at the total of $_______. A deposit of $_______ was placed on said puppy/dog on the date of __________, leaving a balance of $________ to be paid before said puppy is picked up by the buyer. Buyer’s address: ______________________________________________________________ Buyer’s email: ________________________________ Buyer’s phone #:______________________________ Puppy’s birth name:________________________________ DOB:________________ Sex:___ Color:_________________ Dam:________________ Sire:___________________ Breeding rights: Yes___ No___ Buyers Initials ___________ Seller and Buyer agree that the above described puppy is a purebred Standard Australian Shepherd. The kennel prefix “Tennessee Hills” must be used as the first words of the pups registered name.
Purchase Price: Buyer agrees to the total fee of $_________ in purchasing the puppy described above. Seller requires a nonrefundable deposit of $200 to hold puppy in Buyer’s name until full payment is received. Payment may be made by Paypal, cash, check (must be cleared before ownership of puppy), or money order.
To the best of my knowledge, the Breeder, said puppy/dog is in healthy and sound condition at the time of sale. Buyer has 72 hours from the time of delivery/pickup date:______________(excluding weekends and/or holidays) of said puppy to have a licensed veterinarian perform a vet check on the puppy. Minor treatable problems such as diarrhea, coccidiosis, parasites, etc. are common in puppies especially under stress of new circumstances, and will NOT be covered by this warranty, although every effort is made to prevent these issues. For any reason that said puppy does not pass buyers vet check performed by a licensed veterinarian, buyer is to contact seller immediately to discuss findings within the 72 hour time frame and provide a copy of the original signed licensed veterinary statement of health. If buyer fails to have a vet check completed within 72 hour time frame; the parties agree that any guarantee will be considered null and void.
Health guarantee: Our health guarantee does not cover any parasite (internal or external), coccidiosis or diarrhea as these are treatable conditions. Only untreatable, genetic diseases or defects will be considered. Seller warrants this puppy free from “genetic defects”, such as hip dysplasia, deafness, and serious eye defects that would prevent the puppy from being a companion animal, until the puppy reaches one year of age. If said puppy is found to have a genetic defect of this kind, this must be verified by a licensed certified veterinarian as well as written documentation with the vetrinarian's letterhead. We reserve the right to acquire a second opinion from another licensed vet at Buyer’s expense, due to the fact the puppy was checked by a vet prior to leaving our care. In the case of eye deformity, written notification MUST come from a board certified Veterinary Ophthalmologist. In the case of a hip deformity, written notification MUST come from Orthopedic Foundation for Animals (OFA). If a genetic disorder is found as described above, then the puppy shall be returned to the seller at the Buyers expense and the Buyer will then be given the opportunity to choose a new puppy of the same sex and color from the next available litter at no cost to them. If in the event, the Buyer decides to keep the puppy, the puppy must be spayed or neutered at the Buyers expense, and the Buyer will have the option to purchase a new puppy at 50% the cost of the new puppy’s listed price. Under NO circumstances will money be refunded, or the Breeder be required to pay any veterinary expenses at any time. This contract is between the Seller and Buyer(s) signed below. If this puppy/dog that’s described above be sold to a third party, this contract will be void.
Buyer is required to have a licensed veterinarian administer the next two sets of puppy vaccinations and then the adut shot schedule once puppy turns 16 weeks of age, which include rabies and heartworm preventative. Said puppy will come with records indicating the puppy has received the first set of shots and worming. Buyer agrees to follow the regular vaccine, deworming, heartworm and flea treatment schedules for the life of the puppy. If buyer fails to continue such schedule as stated above, the parties agree that this contract is null and void. Buyer must keep shot records from your licensed veterinarian.
Said puppy is warranted as being of PET quality only. This does not mean that he/she is or is not capable of performing other roles, such as showing, performance, or breeding quality. Breeder strongly recommends that the Buyer have pet spayed or neutered. It is our desire that NONE of our puppies/dogs EVER end up in a shelter! In the event that circumstances change, please be responsible in rehoming your dog. We do not take puppies/dogs back in order to protect our own dogs, however, we will be glad to do everything we can to help you find a new home for your puppy/dog. We understand things sometimes change, but please be responsible and make certain this is the breed that matches your lifestyle. Buyers have one week to make arrangements to pick puppy up. If the Buyer fails to pick puppy up within one week, unless efforts have been made to contact Seller and other arrangements made, said puppy will be placed back on the for sale list.
